Texas Man Files Wrongful Death Lawsuit Against Ford Motor Co.

Ford Motor Co. has a wrongful death lawsuit filed against them by the husband of a deceased Texas woman.

Mohammed Aref and Rosemary Johnson are suing Ford on behalf of Aref’s late wife, Sandra Louise Smith. According to the lawsuit, Ford was negligent in the design and manufacture of his wife’s Ford Expedition which ultimately resulted in Smith’s death.

On May 30, 2010, the plaintiffs were traveling on I-30 in a 2003 Ford Expedition when the left rear tire failed, leading to a de-treat event which cause the vehicle to yaw and roll over.

Smith and Johnson were ejected from their seats, even though they were wearing proper seat belts. Johnson and Aref were seriously injured, while Smith died at the scene.

Ford Motor Co. has been accused of negligence for failing to design and manufacture a crashworthy vehicle and for failing to mitigate the risks of complete or partial occupant ejections by belted occupants during rollovers by the use of rollover protection and/or side curtain airbags.

Aref is seeking an award of damages for Smith’s conscious pain and suffering, mental anguish, medical bills, funeral and burial expenses, and for his pecuniary losses. Johnson is also seeking an award of damages for physical pain, impairment, disfigurement, and medical care.
