Humble Bar Sued After Fatal Drunk Driving Accident

A Texas family has filed a wrongful death lawsuit against a Humble bar that allegedly sold large amounts to alcohol to two young men before a dramatic car accident that killed them both. According to the lawsuit filed in Harris County, the company Humble Cricket, doing business as Hoot County Saloon, was grossly negligent in continuing to serve the men alcoholic drinks after they were intoxicated.

The car accident took place at about 2:30 in the morning on Wednesday morning, April 27, in Atascocita. The driver of the car, 23-year-old Eddie McPayne, lost control of the vehicle. It rolled several times, coming to rest upside down on an empty trailer in a U-Haul parking lot.

Both McPayne and the passenger, 23-year-old Bill Gonzalez II were thrown from the vehicle and died from their injuries. McPayne was found in the parking lot and was rushed to a local hospital, where he was soon pronounced dead. Gonzalez was thrown 170 feet from the car and came to rest in a nearby wooded area. Rescue workers were not aware there was a passenger in the car and the man’s body was not discovered until the next day when his father looked for him at the scene of the crash, suspecting that he might have been involved.

According to the Texas Alcoholic Beverage Code and Texas and Texas dram shop laws, a bar, saloon, liquor store, or restaurant can be found responsible for the injury or death of a patron if the company acted in a negligent manner.
