Car wreck cases and the insurance companies

Attorney Ben Glass has a new website with a great article called "What Will Happen to the Defendant?"

Ben makes the point that when car accident cases go to Court, 99% of the time the responsible person has insurance.  And if the case is actually going to Court,  you can be almost certain that it is entirely the fault of the insurance company.

See, even though the Defendant may be a grandmother or teenager or some other sympathetic person, the defendant has absolutely no input on whether his or her own insurance company pays a fair and reasonable settlement. 

And neither does the defense lawyer, most of the time.  The defense lawyer is paid by the insurance company, so he has a strong incentive to do what they say, when they say it. 

Many insurance companies use computer models to determine how much to pay in settlement.  These computer models are set up to guarantee a low ball, unfair, unreasonable settlement.

Other insurance companies will offer bonuses and other incentives to the agents to low ball settlements.

Despite all the commercials talking about how much they "care" about you, insurance companies don't care about you at all.  They care about money, and that's it.  And they don't make money paying claims--they make money denying claims, collecting your premiums, and investing in the stock market.

The teaching point here is this: 
If you ever get on a car accident jury, and you have to decide how much money to give an injured person, just remember that the insurance company probably made a ridiculously low offer and is betting that the jury won't give a lot of money. 

The insurance company is putting 12 citizens and the Judge and its own insured though a trial just to save a little money.

Maybe, if the facts justify it, you should consider "teaching" the insurance company a little something about how to be fair?
