Beaumont woman’s own insurance company tries to avoid paying claim

Being hit by an uninsured driver in Texas can raise a lot of questions, not the least of which is “who will pay for all this property damage and my medical bills?  If the other driver does not have insurance – and if you either don’t have uninsured motorist coverage or you don’t have enough of it – it can be worrisome.  But sometimes you do have coverage, and your own insurance company still finds a way to avoid paying you!

 

A woman from Jefferson County, Lana Scully, experienced just this situation.  She was seriously injured when uninsured driver Padmalochini Natarajan crashed into the back of her car as she was stopped behind another vehicle.

 

The force of the impact that happened on Gladys Avenue in Beaumont left Scully with permanent injuries, physical pain and mental anguish.  Scully also has medical bills to pay and has suffered medical impairment as a result of the crash.

 

In her lawsuit, Scully claims that her insurance company Mercury County Mutual Insurance, was supposed to cover her if she was hit by an uninsured driver.  She further claims that Mercury gave her permission to settle her claim with Natarajan.  However, when Scully later tried to get money from Mercury for the crash, they refused to pay her benefits under her own policy.

 

Did you notice that in this case the insurance company is trying to wriggle out of having to take care of one of its own customers?  It’s not just the other side’s insurance company you have to look out for – sometimes your OWN insurer can play dirty tricks on you!
